Proċess ta’ Stħarriġ dwar Allegat Inġustizzji ma’ Impjegati tal-Air Malta 

Il-Ministeru għat-Turiżmu jinforma lill-pubbliku li ser ikun qed jerġa’ iniedi proċess li permezz tiegħu jiġu mistħarrġa allegati każi ta’ inġustizzji (Grievances) ma’ impjegati tal-Air Malta, kemm preżenti u kif ukoll passati. 

Dan il-proċess jista’ jitratta biss każijiet ta’ allegat inġustizzji relatati ma’ xogħol fl-Air Malta li qatt ma ġew sottomessi quddiem Bord ta’ Inġustizzja jew Reviżjoni, u li dwarhom m’hemmx diġà deċiżjoni minn Bordijiet passati. Każijiet li huma diġà maqtugħa, mhux ser ikunu mistħarrġa mill-ġdid. 

Każijiet li dwarhom ikunu ddeċidew diġà Tribunali tal-Qorti u/jew l-Ombudsman ma jkunux ikkunsidrati sakemm ma jiġix stabbilit li tali deċiżjoni ma ġietx esegwita mill-kumpanija hekk kif maqtugħa. 

F’kull ċirkostanza, il-każ imressaq dwar l-allegat inġustizzja irid ikun seħħ biss bejn l-2007 u l-2014. Każijiet li seħħew qabel jew wara dan il-perjodu, ma jiġux ikkunsidrati.

Każijiet meqjusa bħala eleġibbli, ser ikunu mistħarrġa minn Bord indipendenti mill-kumpanija, appuntat mill-Ministeru.

Kull talba għandha ssir biss bil-miktub u bi spjegazzjoni ċara u ddettaljata dwar l-allegat inġustizzja. It-talba tista’ tkun imsaħħa b’dokumentazzjoni oħra ta’ sapport u evidenza. Fit-talba tiegħu l-applikant għandu jagħti b’mod ċar id-dettalji personali tiegħu (isem u kunjom, indirizz residenzjali, numru ta’ kuntatt, indirizz tal-imejl u staff number). Kull talba għandha wkoll tkun iffirmata mill-applikant.

Meta l-individwu jkun qed iressaq talba taħt dan il-proċess, ikun awtomatikament qed jawtorizza lill-Bord li ser jitwaqqaf biex jistħarreg l-allegat inġustizzji, li jista’ jaċċessa kull informazzjoni jew dokumentazzjoni li fil-fehma tiegħu hi relatata mal-każ imressaq u li tista’ tgħinu biex jieħu deċiżjoni tajba. Il-Bord jista’ wkoll jitlob aktar informazzjoni mingħand l-individwu, u/jew jitolbu jidher quddiemu. 

It-talbiet ser ikunu qed jintlaqgħu minn nhar it-Tnejn 13 ta’ Mejju sa nhar it-Tnejn 10 ta’ Ġunju 2019. Talbiet li jsiru wara mhux ser ikunu kkunsidrati.

It-talbiet għandhom ikunu indirizzati liċ-Chairperson, Bord tal-Inġustizzji (Air Malta) u mibgħuta lill-Ministeru tat-Turiżmu, 233, Triq ir-Repubblika, il-Belt Valletta VLT 1116. Huwa rrakomandat li t-talbiet jintbagħtu permezz ta’ posta rreġistrata, jinġiebu bl-id jew inkella jintbagħtu bil-posta elettronika fuq grievance-airmalta.mot@gov.mt​.

Każijiet li jsiru permezz ta’ telefonati mhux ser ikunu aċċettati u lanqas ikkunsidrati għal stħarriġ. 

Għal kull każ tirċievi riċevuta u numru.

Din is-sejħa għal talbiet dwar allegat inġustizzji fl-Air Malta (għal dan il-perjodu) għandha titqies bħala waħda finali. Id-deċiżjonijiet mogħtija minn dan il-proċess għandhom ikunu meqjusa bħala finali wkoll.

Process to Investigate Alleged Injustices with Air Malta employees 

The Ministry for Tourism informs the general public that it will be re-launching a process by which to investigate alleged cases of injustices (grievances) with Air Malta employees, both past and present.

This process can only deal with cases of alleged work-related injustices at Air Malta that have never been submitted before the Grievances or Review Boards, and for which there has not been a decision by past Boards. Cases already decided, will not be re-examined.

Cases which have already been decided by a Tribunal Court and / or the Ombudsman will not be considered unless it is established that such a decision has not been executed by the company as decided.

In any event, cases made must relate to an alleged injustice which has taken place solely between 2007 and 2014. Cases that occurred before or after this period, will not be considered.

Cases deemed eligible, will be assessed by a Grievances Board, independent of the Company and appointed by the Ministry.

Each request shall be made in writing and with a clear and detailed explanation of the alleged injustice. The request can be enhanced by further supporting documentation and evidence. In its request, the applicant shall clearly provide his or her personal details (full name, residential address, contact number, email address and staff number). Each application must be signed by the applicant.

An application under this process automatically authorizes the Grievances Board to access any information or documentation which in its opinion is intrinsically related to the case presented before it and which could guide them towards a just decision. The Board may also request further information from the individual, and/or ask him/her to appear before it.

Requests will be received as from Monday 13th May to Monday 10th June 2019. Requests received after will not be considered.

Cases made via telephone will not be accepted or considered for review.

Applicants will receive a receipt and a case number.

This call for claims about alleged injustices within Air Malta (for this period) shall be deemed as final. Decisions given through this process must also be regarded as final.
